When you visit or place an order from this site, you are agreeing to the terms and conditions listed below. Please read them carefully so that you are fully informed.

1.TERMS AND CONDITIONS
These terms and conditions apply to all purchases made by you from The Discount Toy Shop website. Occasionally the terms and conditions can change from time to time. Please ensure that you read them before you make any purchase.

2.ACCEPTANCE OF ORDER
The contract in respect of the products supplied by us to you comes into existence when your order has been accepted by us. Please note that receipt of an order via our website does not constitute acceptance of an order.

We are under no obligation to accept your order, but would normally do so where the product is available, the order reflects current pricing and your credit card / debit card payment is approved by your credit card / debit card company.

The display of products on The Discount Toy Shop website is not in any way an offer by us to sell to you. It is your response that constitutes an offer. Accordingly, we are not liable to sell you any product that might be quoted at a price lower than that meant by us.

Upon placing an order, you will be notified of our acknowledgement of your offer to purchase by e-mail. Please note that this is not a confirmation or acceptance of your order.

If during the process it is discovered for any unforeseen reason that we cannot complete a proposed order, we will cancel the order and e-mail you explaining why. Such instances are rare but could be caused by a stock shortage, inability to obtain payment, or the identification of a pricing, product or production description fault.

Once the product ordered has been despatched, your order has been accepted.
It is at this point that a binding agreement will be formally in place based upon these terms and conditions.

Goods supplied by The Discount Toy Shop Ltd are not for resale. The Discount Toy Shop Ltd reserves the right to cancel any orders that are believed to be for this purpose.

3.PRICING
All prices quoted on The Discount Toy Shop website are in pounds sterling.

All prices are inclusive of VAT (where applicable) at the applicable UK rate.
Prices are subject to any changes to the rate or applicability of VAT

We try to ensure that all prices shown on The Discount Toy Shop website are accurate. However, there may be a rare instance where a product has been incorrectly priced. In this instance, where a product’s correct price is lower than the stated price, a refund will be issued for the difference and the order despatched.

Where a product’s correct price is higher than the stated price, we will inform you of the correct price and give you the opportunity to proceed with the order at the correct price or cancel the order.

Whenever a reduced price is shown, the item(s) have previously been on sale at the higher price for at least 28 days.

Pricing and availability is subject to change without notice.

All prices are exclusive of delivery unless otherwise stated. Full details of delivery charges can be found within the delivery section on the site.

All orders for products are subject to availability and we reserve the right to refuse to supply any particular person or conduct a transaction at our sole discretion.

4.PAYMENT
You must be over 18 years old to make a payment.

Payment can be made by the methods provided onThe Discount Toy Shop website.

Payment will be debited from your chosen method of payment at the time the goods are despatched.

5.YOUR RIGHT TO CANCEL YOUR CONTRACT
Under the Consumer Protection (Distance Selling) Regulations 2000, you have the right to cancel your contract up to seven days from when you receive the product, just so long as the product is returned in it’s original packaging, in a saleable condition with any seals or wrapping unbroken.

You will be entitled to a full refund and will not incur any penalty.

You do not need to provide a reason for cancelling your contract.

You are required to inform us of your intention to cancel the contract by telephone, e-mail or in writing.

If you receive the goods prior to cancelling the contract, you will have to pay for the full cost of returning the goods to us at your own risk.

All returned products must be in its original packaging and in a saleable condition.

Once you have notified us that you intend to cancel your contract, the amount debited from your payment card will be credited back to your account once we are in receipt of the goods in a re-saleable condition.

Items returned should be packed so that they will not be damaged in transit.

All returned items must be accompanied by a copy of the original packing note together with a brief reason for return.

If you do not return the goods to us or do not pay the costs of delivery, we shall be entitled to recover the direct costs of recovering the goods from the amount to be re-credited to you.

If you receive an item that you did not order, please notify us as soon as possible.

6.CANCELLATION BY US
We reserve the right to cancel an order.
This may occur in instances where:
We have insufficient stock to deliver the goods that you ordered
We cannot obtain payment.
A product price or offer description fault has been identified
The delivery address is outside of our delivery area.

If we cancel your contract, you will be notified by e-mail and we will credit your account with the sum deducted no later than 30 days from receipt of your order.

We reserve the right to withdraw any product at any time and / or remove or edit any materials or content from the website. We ay refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion.

We will not be liable to you or any third party by reason of our withdrawing any product from this website whether or not that product has been sold: removing or editing any materials or content on the site: refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

7.DELIVERY

Delivery charges cover UK mainland only and are priced at £3.95 per order. For delivery outside of the UK mainland, you should contact us direct by e-mail or by telephone (see contact details).
All deliveries will be sent to the address that was specified in the order. Delivery will be made as soon as possible after your order has been accepted. Every effort will be made to deliver within the timeframe specified.
Standard delivery should normally take four working days, and named day deliveries on the specified day.
Where delivery within four working days is not possible, you will be notified by e-mail, and unless stated otherwise, we will ensure that your product is delivered within 28 days from acceptance. However, this may not apply in respect of deliveries outside of the UK mainland.

We cannot be held responsible for delays in delivery that are caused by third parties or bad weather.

We may at our discretion and expense, deliver parts of your order separately.

All deliveries must be signed for, and you will become responsible for the products as soon as they are delivered and found to be in conformity to the contract.

Once the goods have been delivered to you, they will be held at your own risk, and we will not be liable for their loss or destruction.

Ownership of the products will pass to you once we have received payment in full.

If we cannot deliver the goods to the address that you have specified, for any reason other than that which is our fault, we will notify you and store the products at your risk. If you wish us to re-deliver the product, you will have to authorise us to charge your debit or credit card for any such re-delivery. If we do not hear from you within 28 days, we will cancel the order and refund the cost of the goods to you minus any delivery charges.

Goods delivered outside of the European Union may be subject to import duties, taxes and/or customs charges. These charges are levied once the parcel arrives at its destination, and must be paid for by the recipient.

8.DAMAGED OR FAULTY ITEMS
Do not sign for or accept an order that is visibly damaged. If you receive an item that has been damaged in transit, please notify us as soon as possible and we will arrange its return and replace the item as soon as possible.

Products must be inspected within a reasonable period of time of receipt.
You will be deemed to have accepted the product unless you notify us of your intent to cancel the order in accordance with the process as specified in the ‘YOUR RIGHT TO CANCEL’ section or you notify us that the goods are faulty in accordance with the processes as specified in the section entitled ‘RETURNS POLICY’.

You can return any item that was faulty at the point of sale for either a replacement, a free repair or a full refund., so long as you have proof of purchase and the item in question is returned complete in it’s original packaging.
You will not be entitled to any refund, replacement or repair for general wear and tear.

9. TRADEMARKS AND COPYRIGHT
The Discount Toy Shop trademark is the property of The Discount Toy Shop Ltd.
Other trademarks used on this website are the property of their respective owners.

You are not permitted to use any of the trademarks contained on the site or any similar signs that are likely to cause confusion without written authorisation.

Other than for personal and non-commercial use, you are not permitted to copy, transmit, publish, display, reproduce, distribute, store or modify this website, it’s material, contents or underlying software, without our written authorisation.

10.PROTECTING OUR CUSTOMERS
To ensure that your credit, debit or charge card is not being used without your consent, we will validate the name, address and other personal details supplied by you during the order process against appropriate third party databases.. By accepting these terms, you are consenting to such checks being made.

In applying these checks, personal information supplied by you may be disclosed to a registered Credit Reference Agency, who may keep a record of that information. This is done to prevent any fraudulent activity and confirm your identity. No credit check is undertaken and your credit rate will remain unaffected.

Any information that you provide will be treated in a secure manner, and strictly in accordance with the 1998 Data Protection Act. (Please consult our privacy policy for full details).

If you transmit or post any material to or onto The Discount Toy Shop website, you grant us a non-exclusive, world wide perpetual, royalty free licence to under your copyright and other intellectual property rights, to use or display or distribute that material in anyway without any duty to account to you.

USE OF DATA
When submitting personal details to make a purchase, or if you choose to deliver items to a third party such as a friend, all information such as the name, address, credit card details, e-mail address and telephone number will only be used to process payment, deliver the goods and to contact you.

We can therefore make no representation or warranty that any product is compliant with health, safety and other requirements, which apply outside of the United Kingdom unless delivery is within the EEA and common EEA Consumer Protection and safety rules apply.

These terms and conditions, together our current website prices, delivery details, contact details, returns policy and privacy policy, set out the whole of our agreement relating to the supply of goods from us to you. Nothing said by any member of our staff on our behalf should be understood to be a variation of these terms and conditions.

If any part or parts of these terms and conditions are ever deemed invalid, void or unenforceable, then that part or those parts will be considered severable from these terms and conditions, thereby not preventing the remainder from being enforceable or effective.

We reserve the right to amend or revise these terms and conditions at anytime. You are therefore advised to keep up to date with the contents of these terms and conditions as any revisions are binding upon you.
